Critique of MCC Health Sciences-Fitness Center Finds, Suit ...

A statement for the McHenry County College Board from Stephen Willson is found below.? Willson is the man who punched holes big enough to drive a bulldozer through the billion dollar (with interest) proposal to completely revamp the MCC campus over the next forty years.

As one of the ?Founders? of MCC, I?m still wondering why McHenry County College?s Board stopped using the Woodstock North High School culinary facility and built its own in Crystal Lake. The prior arrangement seemed like wonderful synergy.

He pointed out that there are fewer third graders in McHenry County schools than seniors, which means the 3% annual growth rate assumed by college officials was apparently picked out of thin air.

Now Willson analyses the plan to build was appears to be mainly a nursing training facility, plus occupational, physical and respiratory therapy,? And, oh, yes.? Twenty-eight percent of the building will be for a fitness center to compete with private enterprise.

Remarks concerning the MCC Health Sciences Facility

?McHenry County College is looking to expand its health and wellness programs with a $42 million building and is looking to private-sector partners to help pay for it.?

The college?s board of trustees will vote on a second-phase feasibility study Oct. 25. The study, if approved, will examine whether a public-private partnership will work to create a health sciences facility. It will look into possible sites for a building and identify potential financial partners and funding sources.

College officials maintain that a public-private partnership ? specifically partnerships with those in the health care field ? would pay for the project without going to voters or raising tuition.

?I?m not saying we would never, but none of the discussions this far have addressed [a tuition increase], as well as a referendum,? said Laura Brown, the college?s vice president of institutional advancement. ?We are not going to a referendum.?

?Any private entity has to augment or supplement our educational focus,? Brown said.

For the college?s share of the partnership, it could leverage debt or employ alternative revenue bonds to be repaid with revenues generated by the project ? namely from tuition from an estimated 1,400 new students and 25,000 incremental credit hours each year.

Additionally, students taking health sciences programs likely would see additional classroom fees.

A phase one study concluded that expanding those programs ? specifically occupational, physical and respiratory therapy, and other health and wellness curriculum ? would require a 120,000-square-foot building, 67 percent of which would be used for classroom spaces and 28 percent for a fitness center.

If the board approves the phase two study, it will hire Addison-based firm Power Wellness for $50,000. The board asked Power Wellness also to explore existing buildings and facilities in the county as potential sites for the expansion.

Fact 1.? There is no demand for a program of this size.

Figures from the Bureau of Labor Statistics indicate that there are approximately 350 job openings annually in the ?health care and social assistance? sector in McHenry County.

This includes jobs that require an advance degree, such as doctors and registered nurses, and jobs that do not require any degree, and jobs in the ?social assistance? subsector.

So the annual number of job openings in the health care field in McHenry County that will require a two-year degree is probably half of this, or about 175.

As it is possible to obtain a two-year degree at other institutions in the area and as the job force is fairly mobile, the number of annual job openings available to graduates of the proposed program is probably no more than 100.

Yet MCC projects that they will have 1,400 students in this program, or 700 graduating per year.

If they are correct, then this program is a cruel hoax on the students who enroll expecting to be able to find jobs in health care in McHenry County, as only perhaps one in seven will find a job.

Fact 2. The program cannot be self-supporting.

Assume the College is correct and the program generates 25,000 incremental credit hours. At the current tuition rate of $90 per credit hour, the gross annual revenue would be $2.25 million.

But the annual mortgage payment on a $42 million is $2.7 million or 120% of the projected tuition. This is before one teacher is hired or the electric bill is paid.

MCC, like most schools, spends about 67% of its budget on personnel and less than 10% on mortgage payments. Thus, less than 20% of tuition money, or perhaps $450,000, would be available to pay the $2.7 million mortgage payment.

Fact 3.? 28% of the building is for a health club.

There are more than 20 health clubs in McHenry County now. It does not make sense for MCC to build yet another taxpayer subsidized competitor for local private businesses.

Fact 4.? $42 million divided by 120,000 square feet is $350 per square foot.

This makes MCC twice as fiscally responsible as the Crystal Lake Library, but this is still more than three times the going rate for finished commercial space.

Fact 5. MCC plans to use ?alternate revenue bonds? in order to avoid a referendum.

This law was written so that municipalities could obtain lower interest rates on borrowings for utilities with proven track records, such as water and sewer systems, NOT speculative projects such as this.

I know because I was on the advisory committee that helped to write this legislation.

If MCC seeks to use a loophole to do an end run around the voters and burden the taxpayers, I personally will lead the effort to put the bond issue on the ballot.

Further, I will personally fund a class action suit on behalf of the taxpayers alleging fraud in the issuance of such bonds because there is no institution, no corporation, that will be willing to enter into a 30 year contract to guarantee revenues sufficient to pay for this building.

I will sue MCC?s attorney if he issues an opinion that such bonds are legally issued.

I will sue bond counsel for concurring in such an opinion.

I will sue the financial advisor, the feasibility consultant, and the underwriter.

So, in conclusion, I urge the Board NOT to waste more taxpayer money by giving $50,000 to yet another consultant who is hired to deliver

  • a pre-determined,
  • made-as-instructed,

endorsement of this speculative white elephant.

Near-atomically flat silicon could help pave the way to new chemical sensors

ScienceDaily (Oct. 26, 2012) ? Silicon is the workhorse of the electronics industry, serving as the base material for the tiny transistors that make it possible for digital clocks to tick and computers to calculate. Now scientists have succeeded in creating near-atomically flat silicon, of the orientation used by the electronics industry, in a room temperature reaction. The flat silicon might one day serve as the base for new biological and chemical sensors.

The researchers will present their work at the AVS 59th International Symposium and Exhibition, held Oct. 28 -- Nov. 2 in Tampa, Fla.

"In essence, we have made perfect silicon surfaces in a beaker," says team leader Melissa Hines, a chemist at Cornell University. Researchers had made perfectly flat silicon before, but the prior work focused on silicon surfaces cut along a plane of the crystal that is not used in the electronics industry. Hines' team has created the flat surfaces along the industry-standard crystal orientation.

The creation of the team's first near-atomically flat surface came as a bit of a surprise. It was widely believed that the dissolving process the team used to clean the silicon left rough, bumpy surfaces. Hines was working on a review paper and had asked one of her graduate students to take an picture of the surface using an instrument called a scanning tunneling microscope (STM) that can image surfaces to atomic-level detail. "When we looked at the surface, we unexpectedly realized, 'Hey, this actually looks very flat,'" Hines says.

The microscope images showed a surface with alternating single-atom-wide rows. Using the additional tools of computer simulations and infrared spectroscopy the researchers determined that the silicon atoms in the rows were bonded to hydrogen atoms that acted like a wax, preventing the surface from further reacting once it was set out in the air. "What that means is that if you take this perfectly flat surface, pull it out of the aqueous reactants, and rinse it off, you can leave it lying around in room air on the order of 10-20 minutes without it starting to react," says Hines. "If you had told me as a graduate student that you could have a clean surface that could just hang out in air for 10 minutes, I would have thought you were crazy."

The team believes that part of the reason their silicon surfaces are so flat is that they dip the wafers in and out of solution approximately every 15 seconds, preventing bubbles from the reaction from building up and causing uneven etching. However, they also credit the STM images for helping them to realize just how flat the surfaces were. The team built off the information from the images by using computer simulations and other tools to reveal the exact chemical reaction steps that took place in solution. "Experimentally, this is very simple experiment: you take a piece of silicon, you swirl it in a beaker with solution, and then you pull it out and look at it. To be honest, there is no reason to think that Bell Labs did not make a surface as good as ours twenty years ago, but they did not look at it with STM, so they did not know," says Hines.

Hines' team is now working on adding molecules to the atomically smooth, hydrogen-terminated silicon surface in the hopes of building new chemical or biological sensors. "At this point, I can't tell you exactly how we will accomplish this, but we have promising results and hope to be able to report more soon," says Hines.

What exactly is fishing? I suppose it may be a sporting activity, a way to earn a living, although I am more of a mind to deem it to be a hobby as it is the ideal antidote for fighting any amount of stress.

Fish is an important food item which we cannot do without and we can always rely on working fishermen to keep the stocks plentiful. On the other hand, fishing is also a leisure interest and is one of the most popular hobbies.

The hobby of fishing continues to grow and there?s more money spent on it than arguably any other on account of the cost of buying a licence, fishing tackle, bait, clothes and transport etc. Often creating your own, obtaining second hand or borrowing it allows us to keep the costs down to a minimum.

Why is fishing a popular hobby? Just because it?s an excellent means of relieving stress and tension. It also helps anxious teenagers to adjust their way of thinking and form more constructive qualities, attitudes and activities.

You can find lots of family crafts and hobbies that could be taken on and enjoyed by one and all, this includes fishing.

Children in particular are keen to find out how to use bait in order to catch themselves a fish. Actually using and trying out each and every item of fishing gear in conjunction with a camping holiday may make them feel like characters in a Mark Twain novel.

It is necessary that we all realise the true worth of fishing as a recreational hobby, specially as it is just one of a few hobbies for men and women that they can both participate in and enjoy.

People of all ages enjoy fishing with their families or to take up many more family crafts and hobbies in order to alleviate the anxiety or boredom which lifestyles of today might bring about.

Fishing helps you to take in and enjoy all the benefits and beauties given to us by nature, such as rivers and riverbanks, birds and other animals. Fishing is a much preferred way to relax and take in the air.

Family together time has fallen considerably in recent years and for that matter so has the time spent interacting with the kids so any time set aside for family crafts and hobbies should help to restore a happy family environment.

Although there are many hobbies for men and women that you could do, chances are you can include the kids or your best friends in these pursuits too; it would be time well spent.

Catching the fish is the best feeling, regardless of if you catch them to cook and eat or just for the pleasure in catching them and releasing them again. The time we spend connecting with friends and family is well worth making the effort.

A great time can be had by all if you invest your leisure time wisely in family crafts and hobbies. The fun and learning experiences you acquire from such hobbies, like fishing, can make them family activities which will never be forgotten.

Fortunately, this has turned out not to be another fish story. However, if fishing as a hobby doesn?t float your boat then hopefully it will now motivate you to consider books on hobbies for men and women and the children too, to help find one that does.

Soon after T. J. Rubin got into the apartment leasing business in late 2008, the market had some news for him: He was mostly going to be in the condo leasing business instead.

At that time, Chicago home values were plummeting, and many owners whose circumstances had changed?they?d had babies, job changes, or divorces?found they couldn?t afford to sell at a big loss. Inquiries began to come into Rubin?s firm, Fulton Grace Realty about renting out condos, and Rubin accepted, first a few and then dozens. Now about 60 to 70 percent of his business is renting and managing single condos. The company handles about 310 of them, up from 213 at the beginning of the year.

Condo owners turn to rental, Rubin says, because ?100 percent of them say, ?Do I want to take a $50,000 bath at the [sale], or do I want to lose $200 a month while I wait for prices to recover?? It?s the lesser of two evils.?

That?s what motivated Andy Madaychik to rent out his three-bedroom Logan Square condo three years ago. The value was down about 18 percent from his 2006 purchase price, but he was getting married and moving to Aurora to start a family.

?I looked at the prospect of selling it,? Madaychik says, ?but I was going to lose so much money. If I rented it, I could use that to pay most of the mortgage and hold on. Hopefully prices will go up eventually.? He loses more than a hundred dollars a month in the deal, he says, but ?all the rental money is being used to [build up] equity in the condo, so it will be fine.?

Rubin says the condo owners who rent out a property typically are those who either lose or make an acceptable couple of hundred dollars a year. If they stand to lose $500 or more a month, he says, ?they?re more likely to sell at a loss instead of losing $6,000 a year.? Some at that or a higher level of loss may also be letting the condos go into foreclosure.

Often, Rubin or someone else in his 20-person firm has to start out by delivering some bad news to the condo owner. As he puts it, ?the market doesn?t care what you owe.? Which is to say, you don?t necessarily get to rent the condo at the amount you owe on the mortgage each month. Instead, Fulton Grace provides a rental market analysis that suggests how much the condo will rent for. ?We have people making money, and we have people breaking even,? he says, though he wouldn?t say how many are in those categories and how many lose money.

Fulton Grace?s charges are:

*The first month?s rent once a tenant is landed. There?s no charge until the place is rented.

*After that, ongoing management costs seven percent of the monthly rent.

Thus, for a condo that rents for $2,000 a month, Fulton Grace?s services would cost the owners $2,000 at rental and $140 a month.

For someone already losing money, are these services worth it?

?I live out in Aurora,? says Madaychik, who can?t get into the city easily because of family and business obligations. Rubin notes that other condo owners using his firm live even farther away, in distant states and a few other countries. On top of that, he suggests, it?s worth the cost to secure a good, stable tenant?Fulton Grace runs credit and employment checks on applicants?and to have both maintenance and emergency repairs handled. The firm has its own handyman service that can tackle problems any hour of any day, he says.

There?s also the payoff of not having to deal with the stress of being a landlord. ?Of our condo owners, about 75 percent are first-time landlords who didn?t want to be landlords,? Rubin says.

Bloomington, Ind.- Business students at Indiana University will be filmed during major exams after the Kelley School of Business installed cameras in the classrooms to curb cheating. (This is a just another way to condition our students that it's normal for authorities to be watching them 24/7)

"Like every school, we're concerned about ensuring that students aren't cheating on exams," said Interim Dean Idalene Kesner.

She explained that the school has been testing the cameras since the spring semester and put them into action during midterms this fall.

Kesner told Fox 59 the cameras caught several instances of suspicious activity that would've been missed otherwise.

"I'm not sure we would've caught these instances without the camera," said Kesner.

The cameras were bought as a result of the school's rapidly growing enrollment. It serves nearly 5,000 undergraduate students and Kesner said, the school was short on proctors.

"There simply are not enough people to go around during crunch periods of testing," said Kesner.
During an exam, a trained employee watches the feeds from the cameras in a separate room and then informs the instructor of any activity that resembles academic misconduct.

Even with the surveillance video, faculty members decide what to do with what they see.

The World Human Resources Congress was held in Australasia for the first time ever on September 26th and 27th 2012. This opportunity was too great to be missed and hence QJumpers members Simon Oldham and Lloyd Cloughley decided to jump the ditch and head on over.
The quality of speakers was incredible; including Steve Wosniak (co-founder of Apple), Li Cunxin (author of Mao?s last dancer), Cathy Freeman (400m Olympic gold medallist), Dave Ulrich (HR guru), Rachel Botsman (Social Media trending guru), Daniel Pink (staff motivational expert) and many many more??
The event attracted over 3,500 participants from around the world and over 150 of the leading global suppliers to the exhibition area. It really was a who?s who of HR. It was great to see so many kiwis there too.

I have highlighted the key points that I took from the sessions that I attended.

Dave spoke at length about how we in the HR area of our businesses need to start looking at everything from the outside in; rather than how we see ourselves. This is relevant in all parts of business.

Something that can help us to look form the outside in is to ask ?so that? 3 times when performing our duties. E.g. ?So that we can deliver on time, so that we can sell more, so that the shareholders are happy? ?
To keep HR delivering value, we need to think what is happening outside of our own industries. Can this affect our industry in the future. How can we use it?

We need to anticipate what our clients need before they need it. This is relevant for both of our internal and external clients.

The three most important questions that we need to focus on in HR are:
1. Talent
2. Leadership
3. Culture

Social networking is becoming a service network to get things done rather than just connecting or communicating like we think of it now.
There has been a trust evolution from the Information Age (emails), to the Social Age (connecting people to each other) to the collaborative age ? using technology to share assets ? and people actually meeting to meet a need. This is called Online to offline (OTO) and it is taking the power away from large corporates and putting into the hands of the masses.

People are able to make and save money from their assets (e.g. Car for delivery, kitchen to sell food).
Through referrals and/or online feedback systems, technology is now being used to build trust between strangers. Trust is an essential part making OTO work.
?Reputation capital? will take over ? built up from the comments and rankings that others give us over various websites. This will eventually define us and how we will get jobs.

Stack overflow is a working example of this whereby website developers gain a reputation by answering questions. Their answers are then rated by their peers and a score is allocated. The better the answer and the more questions answered, the better the score. IT recruiters now look to this score as an indication of a developer?s skill rather than their CV.

?If-then? rewards only work for short term simple tasks but leads to poorer performance for even rudimentary cognitive skill. Money is a motivator. Pay people enough to take money off the table so they can focus on work.

Gen-Y?s go from instant feedback in their everyday life (e.g. text messages, searching on their phones, Internet) to entering the workforce and getting annual performance reviews. No wonder they are dissalusioned entering the workforce. They need constant feedback.

There are three key things to keep people motivated:
1. Autonomy
2. Purpose
3. Mastery

1 Autonomy
Management is designed to get compliance ? to do what the company wants its employees to do. It does not give engagement. For engagement, you want autonomy, self-direction in the following things:
? Time
? Team
? Technique
? Task

Facebook employees ? after three weeks and working in the various departments, the new employee chooses which department they want to work in. Some companies offer free time where employees can do whatever they like as long as it benefits the company and they present it to everyone afterwards. Often called a ?FedEx day?. Non commissioned work.
Intuit, google, atlassiat do it too?.

2 Purpose
Why are we doing what we are doing? Why does it matter? To get better engagement employers need to have dewer discussions around how we do it and more around why we do it. Getting buy-in brings engagement

3 Mastery
People want to improve. One of the biggest motivators in the workplace is when people make progress in meaningful work. But in order to know that they are making progress and do a good job they need feedback.

The World Federation of People Management Associations (WFPMA) and The Boston Consulting Group (BCG) have joined forces to conduct the 2012 worldwide HR survey on ?Creating People Advantage.? It is the largest quantitative survey of its kind and an established benchmark, providing leaders with insight into the developments and challenges in HR and people management.

Jean Michel Caye presented the findings of this survey. The key findings were:

Tuesday morning San Benito Mayor Joe Hernandez turned himself into the Carrizalez-Rucker Detention Center in Olmito in connection with the ?Raspagate? scandal.?

He is charged with abuse of official capacity and tampering with government property.? A $5,000 bond was posted.

We attempted to ask the mayor about the charges as he was leaving the detention center.? Hernandez said, ?My attorney advised me not to comment,? by his side attorney Rey Rodriguez.

Hernandez is accused to have used his barbershop property to allow a mobile ?raspa? or Noe?s Tropical Sno-Wiz stand to operate, which is against city ordinance.? The property is located on Robertson Street.

According to the indictment on July 11, 2011 the mayor placed a revision in the San Benito City Commission agenda to ordinance 2385-A when he knew a conflict of interest existed.?

Back in January he spoke to Action 4 News about the allegations involving the ?raspa? stand.?

Hernandez said ? I guess I just happened to get permission from somebody to put my raspa stand next to my property.?

Hernandez told Action 4 News there are dozens of other businesses in the city doing the exact same thing.?

Tuesday neither the city attorney nor mayor would return our calls.

Insurance Company Hosts Program to Keep Jobs In State

"Insurance is more than going out there, paying claims, and writing policies," said 11th grade Eaton Intermediate student Tyler Wade.

It's a lesson he's learned since his classes began at the Farm Bureau Headquarters, though he'd never considered working in the insurance business before: "Not at all. I never thought about it like that."

He and his 17 classmates spent the first few hours of every school day here, seeing how the business works from the inside, and considering new goals.

It's a program never tried before, but the idea by the Eaton Intermediate School District was well received by everyone; particularly the students who don't have to pay.

"Students can earn nine credits at Olivet College along with certifications in the insurance field...that will land them employment," said Associate Superintendent of Eaton Rapids Intermediate School District Ralph Hansen.

That would mean thousands of dollars saved if these students chose to go to Olivet College, one of the few schools offering an insurance major.

It will benefit all the local insurance companies to have more, and better trained applicants.

"It the tri-county area, insurance is responsible for 8,000 to 9,000 jobs," said Executive Vice President of Farm Bureau Insurance Jim Robinson; particularly looking to hire tech-savvy people.

"We have jobs in information systems, IT, marketing, public relations,"

And now that Tyler knows about more options, "Insurance deals with a lot of legal stuff...that's where I wanna get in," he's more prepared for college.

This is the second year of the program. Many of the students who took it last year already have new internships and jobs. The program is expected to grow into having many more students and classes.

Obama?s Inflated Jobs Claim

In a new TV ad, President Obama makes an inflated claim to have added 5.2 million new jobs. The total added during his time in office is actually about 325,000.

In the ad, the president says ?over 5 million new jobs? while the figure ?5.2 million? appears on screen. But that?s a doubly misleading figure.

  • Viewers would need to pay close attention to the on-screen graphic to know that the ad refers only to employment gains starting in March 2010, omitting the 4.3 million jobs that were lost in the first year of Obama?s term.
  • And there?s no way a viewer would know that the total counts only private-sector jobs, omitting continuing losses in government employment.

According to the most recent employment figures from the Bureau of Labor Statistics, the economy has eked out a net gain of 325,000 jobs since January 2009, when Obama took office. And that?s giving credit for roughly 386,000 jobs that the BLS has announced, on a preliminary basis, that it will be adding to this year?s employment totals next year, as a result of its routine annual ?benchmarking? analysis.

Looking only at private-sector jobs, it?s true that the total has risen just under 5.2 million since February 2010 ? provided that credit is given for roughly 453,000 private-sector jobs to be added next year through the BLS benchmarking process. But over Obama?s entire term, those private-sector jobs have gone up only 967,000, even counting benchmarking additions.

Other claims in the ad are essentially accurate: Exports are rising; home values have begun to recover; U.S. automakers are making profits, for example. And viewers can judge for themselves how they feel about the ?plan for the next four years? that the president briefly outlines in the ad, which is couched in broad generalities.

But viewers who follow the ad?s invitation to visit an Obama website for further information will find some false and misleading claims. There, the campaign, for example, states that ?Mitt Romney criticized the end of the Iraq war as ?tragic,? and has offered no plan withdraw our troops from Afghanistan.?

In fact, as we?ve reported before, Romney did not call the end of the Iraq war ?tragic.? He used that word to describe the president?s pace of troop withdrawal, not ending a war. And more important, there is no longer any difference between Romney?s position and Obama?s plan to pull all U.S. combat troops out of Afghanistan by the end of 2014. Romney, whose position has evolved from criticism to unqualified acceptance, said during the final presidential debate on the night before the ad was released: ?[W]hen I?m president, we?ll make sure we bring our troops out by the end of 2014.?

Law clinics improve community life, serve as teaching tool, Pt. 1

Eight law clinics are currently operating within the College of Law at FIU. There, law students are not only gaining hands-on experience in many areas of practice but also improving the lives of their fellow community members. In this first part of a two-part story, we tell you about some of the cases handled by the Consumer Bankruptcy Clinic, the Environmental Law Clinic, the Family and Children?s Advocacy Clinic and the Immigrant Children?s Justice Clinic.

When Peggy Maisel joined the faculty of the College of Law in 2003, she did so with a clear goal in mind: to establish a flagship clinical program that provides students with hands-on experience outside the classroom.

In August 2004, Maisel and former College of Law Professor Troy Elder launched the inaugural law clinic, the Carlos A. Costa Immigration and Human Rights Clinic. Currently, there are eight clinics and a ninth is being planned to work on behalf of veterans.

About 45 percent of FIU Law students work in a clinic before graduation. Through the end of the 2011-?12 year, the students had provided more than 27,000 hours of free legal services to approximately 400 individuals, groups and organizations. That is equivalent to a court-approved value of more than $2 million in free legal services, exclusive of faculty time.

?We are very much a law firm focusing on educating the next generation of lawyers through close supervision of law students as they practice for the first time and provide policy advocacy and community education throughout Miami-Dade,? said Maisel of the clinics, which primarily serve underprivileged individuals and nonprofits that must meet a certain threshold to receive services.

Consumer Bankruptcy Clinic

The Consumer Bankruptcy Clinic focuses on helping people get a fresh start.

Clinic director Leyza Blanco, an attorney with GrayRobinson, P.A., says students enrolled in her clinic ? which has been operating for about three years with funding from the Bankruptcy Bar Association ? primarily work under the supervision of bankruptcy attorneys on Chapter 7 and Chapter 13 bankruptcy cases. Typical cases involve individuals seeking to have their driver privileges reinstated or people who are in financial hardship due to medical debt or extreme circumstances. They handle 14-16 cases each semester.

?We had a client who had deteriorating eyesight. He?d borrowed money to attend a technical school, but by the time he finished studying, his sight was really bad and he couldn?t work and make a living,? Blanco said. ?He retained us to seek a discharge of some of his student loans in court, which is incredibly difficult. But his was a special case, and we were able to discharge it successfully.?

Barry Turner JD ?10 is an attorney in the bankruptcy practice group at Greenspoon Marder, a West Palm Beach-based law firm. He worked on this particular case as an FIU Law student and remembers it being a one-of-a-kind experience.

?I learned the skills to negotiate with other lawyers, how to draft a complaint, how to draft motions, and aspects of the Bankruptcy Code,? he said. ?It was great to be part of an enterprise that gives individuals a fresh start that would, under different circumstances, cost them thousands of dollars.?

Italian earthquake case is no anti-science witch-hunt

Manslaughter verdicts for six seismologists highlight the need for scientists to speak for themselves

It is easy to feel outrage at the jail terms handed down to six Italian seismologists and a civil servant this week. How could anyone hope to have predicted the earthquake that devastated L'Aquila in 2009?

That is the rallying cry, but failure to predict the quake is not, in fact, what the seven men have been convicted of. The prosecution made it crystal clear all along that their case was about poor risk communication; it was built on an accusation of giving out "inexact, incomplete and contradictory information".

On this charge, there was clearly a case to answer. Employed by Italy's Major Hazards Committee to assess earthquake risks and communicate them to the government and the public, the seismologists got the science right, but left the job of public communication to a civil protection official with no specialist knowledge of seismology. His statement to the press was, to put it mildly, a grossly inaccurate reflection of the situation: "The scientific community tells us there is no danger, because there is an ongoing discharge of energy. The situation looks favourable." At this point, the seismologists should have stepped in. But they did not, and the message stuck.

Of course, it is debatable whether this neglect merits a manslaughter conviction and six-year jail term. That is a matter for the Italian justice system. The appeals have already started.

But there are broader issues to consider. Many commentators argue that the L'Aquila verdict will have a chilling effect on the provision of scientific advice in Italy and beyond. That is clearly a concern worth taking seriously.

However, it should also encourage scientists who take on those roles to think long and hard about the responsibilities that come with them. It is tempting for scientists to defer communication with the public to others who are supposedly "experts" in doing so. But this approach often leads to confusion, as evidenced by a litany of failures in the past: BSE, vaccines, genetically modified crops and many more.

This cannot continue. Scientists valued for their expertise should speak for themselves rather than letting others speak for them. Lives are at stake.

McGovern's Legacy Greater Than His Landslide Defeat

A liberal icon from a Republican family, symbol of the American progressive movement, and former presidential candidate George McGovern passed today at the age of 90. A war vet and human rights advocate, the former South Dakota lawmaker's legacy is colored by the lens through which it's viewed.

Best known for his landslide defeat to incumbent President Richard Nixon in the 1972 election, to some politicians McGovern's failure came to represent a cautionary tale of what happens when party purity takes priority over leaning toward the center.

Banking on the social unrest of the time, McGovern ran in steadfast opposition to the Vietnam War, swearing at the Democratic National Convention that, "as one whose heart has ached for the past 10 years over the agony of Vietnam, I will halt a senseless bombing of Indochina on Inaugural Day." And he vowed to "resolve that never again will we send the precious young blood of this country to die trying to prop up a corrupt military dictatorship abroad."

To the Nixon campaign, the lawmaker's liberalism was out of control and out of touch. In truth, during that cycle the Democratic Party did run on one of the most progressive platforms in caucus history. In addition to vowing to end American involvement in Vietnam, the party promised amnesty for those who refused the draft. The platform also guaranteed yearly minimum income for all Americans, and even a guaranteed job.

The McGovern campaign was also a teaching moment in the dangers of not properly vetting a running mate. It dropped Sen. Thomas F. Eagleton from the ticket after mere weeks when it was learned the Missouri Democrat had been hospitalized multiple times for mental health issues and had undergone electroshock therapy. McGovern eventually selected R. Sargent Shriver as a replacement, but the damage had already been done as columnists of the time mocked McGovern for so steadfastly championing his first pick.

The result was a humiliating defeat, with McGovern only pulling in 37 percent of the popular vote to Nixon's 60. The electoral college was even less forgiving, with McGovern losing in every state but Massachusetts.

A World War II bomber pilot who flew over Germany, McGovern lamented being labeled as a peacenik or outside the mainstream.

"I always thought of myself as a good old South Dakota boy who grew up here on the prairie," he said in 2006 interview with the New York Times. "My dad was a Methodist minister. I went off to war. I have been married to the same woman forever. I'm what a normal, healthy, ideal American should be like."

"But we probably didn't work enough on cultivating that image," he added, "We were more interested in ending the war in Vietnam and getting people out of poverty and being fair to women and minorities and saving the environment."

For decades after the election the McGovern name was used as a stereotype of progressives too soft on war and social issues. Although he continued his career in Congress until a defeat in 1980, when he ran for president again in 1984 he couldn't make it out of the primaries.

The fallout from the 1972 election wasn't all negative. McGovern's campaign was the unknowing victim of the Nixon Watergate scandal, which broke after the election and eventually led to his resignation in 1974. And before that final flight on Marine One, Nixon himself adopted some of the guaranteed income programs McGovern's enemies criticized.

George McGovern's Legacy

Furthermore, McGovern was partly responsible for the political primary system as we know it today. In 1969 the Democratic Party's McGovern-Fraser Commission vastly subdued the power of political bosses, making it easier for candidates to ride an ideology's popular support into a nomination; a tactic McGovern used when he left the commission in 1971 to run.

ABC News political analyst Matthew Dowd points out the election paved the way for Democratic leaders decades later.

"You can lose, but still basically carry the day," Dowd said on This Week today. "Without George McGovern we would have never had Jimmy Carter and we would have never had Bill Clinton."

Indeed, as Yale law school students Bill Clinton and Hillary Rodham both served as staffers on McGovern's Texas campaign. President Bill Clinton would go on to attend the dedication of the McGovern library in 2006.

In a written statement, Secretary Clinton said, "The world has lost a tireless advocate for human rights and dignity."

"Of all his passions, he was most committed to feeding the hungry, at home and around the world," she said. "The programs he created helped feed millions of people, including food stamps in the 1960s and the international school feeding program in the 90's, both of which he co-sponsored with Sen. Bob Dole."

A winner of the World Food Prize with the former Republican presidential candidate, McGovern served as the U.S. ambassador to the United Nations Agencies for Food and Agriculture from 1998-2001. He would also form the George McGovern-Robert Dole International Food for Education and Nutrition Program in 2000 to provide meals to children in the United States and around the world.

McGovern remained an active voice in public affairs until his final days, authoring books and continuing his anti-war message to Iraq and Afghanistan. He particularly assailed the rightward shift in the Republican Party and what he believed was a reluctance in progressives to speak up, for fear of seeming weak.

"For people who have never been near a battlefield [?] to accuse critics of being soft on national security and soft on communism and soft on terrorism, I think is preposterous," he said in 2006.

Evoking former President Dwight D. Eisenhower's cautionary words on the power of the military-industrial complex, he warned of the dangers of unrestrained jingoism.

"Now a five-star general can say that without accused of being soft [?] but I suppose a liberal Democrat ? which I am ? is not allowed to say that."

Today President Obama called him a "statesman of great conscience and conviction."

"When the people of South Dakota sent him to Washington, this hero of war became a champion for peace," he wrote.

ST. LOUIS (AP) ? Offense has a lot to do with San Francisco's streak of 13 consecutive victories when Barry Zito is on the mound, given they're averaging more than six runs.

In Game 5 of the NL championship series Friday night, with their season on the line, they didn't need all that production. Not with the pitcher they thought they signed a half-dozen years ago showing up in shutdown form.

Zito dominated into the eighth inning of a 5-0 victory over the St. Louis Cardinals that sent the best-of-seven series back to San Francisco. The Giants cut their series deficit to 3-2 heading into Game 6 on Sunday night, with Ryan Vogelsong set to face Chris Carpenter for the second time in the series.

"We needed that kind of performance from him because there is no tomorrow for us," second baseman Marco Scutaro said. "We just needed to get back home."

The defending-champion Cardinals still have two chances to make it to back-to-back World Series as a wild card.

"It should be another battle," St. Louis third baseman David Freese said. "San Francisco is a great city, but I wish we weren't going back."

The 34-year-old Zito looked like the pitcher who won 23 games and the 2002 AL Cy Young with the Athletics. He retired 11 batters in a row at one stretch while scattering six hits with six strikeouts in 7 2-3 innings.

Giants catcher Buster Posey twice tapped Zito on the chest when he was pulled in the eighth. It was Zito's fifth postseason win but first since 2006, shortly before he left the A's and signed a $126 million, seven-year contract with San Francisco.

"This is definitely it for me," Zito said. "Coming here, really doing it in a Giants uniform. A lot of people were saying stuff about my A's days. And for me, the most important thing is doing everything for San Francisco right now."

Zito was left off the postseason roster when the Giants won the 2010 World Series because he had pitched so ineffectively.

"Well, you know, it was certainly a huge blow just personally to be left off that roster," Zito said. "But you've got to be professional, you can't pout and such like that.

"I worked on a lot of things that offseason, came back stronger for it, I think."

Zito's 15-8 record this year was his first winning mark since joining the Giants. He started Game 4 of the division series against the Reds earlier in this year's playoffs and lasted only 2 2-3 innings.

"He's been through a lot, I know," manager Bruce Bochy said. "But this guy, he is some kind of tough. He put on quite a show."

The Cardinals might have thrown away a chance to clinch a second straight World Series trip. Pitcher Lance Lynn's toss on a possible forceout deflected off the second base bag, paving the way for the Giants' four-run fourth.

Lynn was trying to turn the front end of a double play.

"I turned to throw it and I just threw it in the ground," Lynn said. "Just a bad play. You make a good throw there and we are out of the inning. It was one of those times where I just short-armed it a little bit."

Pablo Sandoval homered for the second straight night and Zito made an extremely rare offensive contribution with a perfectly executed bunt for an RBI single.

Giants defenders made several nice plays behind Zito, including a juggling catch in right by Hunter Pence and a spectacular sliding stop by Scutaro to rob pinch hitter Shane Robinson on consecutive at-bats.

"They were all huge," Zito said.

Once again this postseason, the Giants benefited from a big error.

Needing three straight wins at Cincinnati to avoid elimination in the division series, San Francisco began its comeback on a bobble by third baseman Scott Rolen in the 10th inning that gave the Giants the go-ahead run in Game 3.

The Giants improved to 4-2 on the road this postseason and have won Zito's last 13 starts, with the last setback on Aug. 2. They're averaging more than six runs during the streak, although the lefty didn't need much help in this one.

Lynn, an 18-game winner in his first year in the rotation, failed to make it out of the fourth for the second time in the series.

The Cardinals are seeking consecutive pennants for the first time since 1967-68, and trying to advance for the second year in a row as a wild-card entry. One more win would set up a rematch of the 2006 World Series against the Tigers, which the Cardinals took in five games.

Lynn struck out five of the first 10 batters, sailing through the first three innings with no balls hit out of the infield. His wild throw to second proved his undoing.

The Giants had runners on first and second with one out when Lynn gloved a tapper by Pence, wheeled and threw while Kozma hustled to second. Lynn's throw wound up in shallow right field and Scutaro scored without a play from second.

Eighth-place hitter Brandon Crawford singled up the middle with the bases loaded on a full count with two outs as Lynn just missed with a kick save for two more runs. Zito, who has just 30 hits in 310 at-bats in the regular season with no extra-base hits and nine RBIs, laid down a perfect bunt for a fourth run.

Lynn has allowed four runs in both of his NLCS starts, although all four were unearned in Game 5.

NOTES: Standing room attendance for Game 5 was 47,075, a franchise-best for league championship play, topping the previous best in Game 4 by 13. ... Longtime Cardinals broadcaster Mike Shannon bounced a ceremonial first pitch from in front of the mound to Lou Brock, teammates on the last St. Louis team to go to consecutive World Series in 1967 and '68. ... Cardinals rookie RHP Trevor Rosenthal struck out four in two scoreless innings. He has fanned 11 in 6 2-3 scoreless innings in the postseason while allowing just one hit. ... The Cardinals were shut out for the first time since Game 4 of the 2011 World Series, a 4-0 loss at Texas. ... Freese doubled in the second and has gotten at least one hit in all of his 14 postseason starts at home. It's the third-longest home hitting streak to start a postseason career.
