Storm closes hundreds of schools across Northeast (AP)

SOUTH WINDSOR, Conn. ? Thousands of schoolchildren around the Northeast had one of the earliest snow days in memory on Monday after a snowstorm dumped as much as 30 inches of wet, heavy snow that snapped power lines and trees, causing widespread power outages that threatened to disrupt Halloween trick-or-treating.

Communities from Maine to Maryland went into now-familiar emergency mode as shelters were opened, inaccessible roads were closed, regional transit was suspended or delayed and local leaders urged caution.

The storm's lingering effects likely will outlast the snow. Temperatures are expected to begin rising Monday and the heavy, wet snow will start melting, the National Weather Service says.

The unseasonably early nor'easter had utility companies struggling to restore electricity to millions of homes and businesses. By late Sunday, the number of outages had dipped to below three million and continued falling. But Officials in some states warned that it could be days or even a week before residents have power again, even though crews have been brought in from as far away as Michigan and Canada.

"We are in full restoration mode," said Marcy Reed, president of National Grid Massachusetts.

Some local officials canceled or postponed Halloween activities, fearful that young trick-or-treaters could wander into areas with downed power lines or trees ready to topple over.

"With so many wires down...the sidewalks will not be safe for pedestrians (Monday) night," said Danbury Mayor Mark Boughton told The Hartford Courant. "We have 200 streets with wires down ... (we) would hate to have children hurt."

A weekend that should have brought activity no more strenuous than raking colorful autumn leaves left Northeasterners weather-weary.

"You had this storm, you had Hurricane Irene, you had the flooding last spring and you had the nasty storms last winter," Tom Jacobsen said Sunday while getting coffee at a convenience store in Hamilton Township, N.J.

"I'm starting to think we really ticked off Mother Nature somehow because we've been getting spanked by her for about a year now."

The storm smashed record snowfall totals for October and worsened as it moved north. Communities in western Massachusetts were among the hardest hit. Snowfall totals topped 27 inches in Plainfield, and nearby Windsor got 26 inches. The snowstorm was blamed for at least 11 deaths, and states of emergency were declared in Connecticut, Massachusetts, New Jersey and parts of New York.

"Look at this, look at all the damage," said Jennifer Burckson, 49, after she came outside Sunday morning in South Windsor to find a massive tree branch had smashed her car's back windshield. Trees in the neighborhood were snapped in half, with others weighed down so much that the leaves brushed the snow.

Compounding the storm's impact were still-leafy trees, which gave the snow something to hang onto and that put tremendous weight on branches, said National Weather Service spokesman Chris Vaccaro. That led to limbs breaking off and contributed to the widespread outages.

"This is not going to be a quick fix," said Peter Judge, a Massachusetts emergency management official.

The more than 800,000 who lost power in Connecticut broke a record for the state that was set when the remnants of Hurricane Irene hit the state in August, said Gov. Dannel P. Malloy.

This outage will be worse than the one caused by Irene, said Peter Bloom, 70, of South Windsor, because he relies on electricity to heat his home.

"I'm going to put another blanket on. What else can I do?" he said Sunday as he gassed up a snow blower to clear his driveway. "At least I'll save a few bucks on my electric bill."

The severity of the storm caught many by surprise, and it disrupted Halloween plans, too.

Sharon Martovich of Southbury, Conn., who was grocery shopping Sunday morning in nearby Newtown at one of the few businesses open for miles, said she's hoping the power will come back on in time for her husband's Halloween tradition of playing "Young Frankenstein" on a giant screen in front of their house.

"We would be really sad and it would disappoint a lot of people if we can't play `Young Frankenstein,'" she said. But no matter what, they will make sure the eight or so children who live in the neighborhood don't miss out on trick-or-treating.

"Either way we will get the giant flashlights and we will go," she said.

She was already making the best of the outage. After her power went out at about 4 p.m. Saturday, she invited neighbors over for an impromptu Halloween party with wine and quesadillas in front of her propane fireplace.

Around Newtown, snow-laden branches were snapping off trees every few minutes. Roads that were plowed became impassible because the trees were falling so fast.

Along the coast and in such cities as Boston, relatively warm water temperatures helped keep snowfall totals much lower. Washington received a trace of snow, tying a 1925 record for the date. New York City's Central Park set a record for both the date and the month of October with 1.3 inches of snow.

But in New Hampshire's capital of Concord, more than 22 inches fell, weeks ahead of the usual first measurable snowfall. Trees downtown still bright with fall colors were covered with snow. Some didn't survive ? a large oak tree that had stood alongside the Statehouse fell, partially blocking a side street.

By 8 a.m., Dave Whitcher had already been clearing dozens of parking lots around town for eight hours as part of his work as a property manager.

Holding up his shovel, he said, "Me and this guy are going to get to know each other real well today."

Some other inland towns got more than a foot of snow. West Milford, N.J., about 45 miles northwest of New York City, saw 19 inches by early Sunday.

New Jersey's largest electric and gas utility, PSE&G, warned customers to prepare for "potentially lengthy outages" and advised power might not be fully restored until Wednesday. More than 612,000 lost electricity in the state, including Gov. Chris Christie.

Utility crews were out in force Sunday, but downed trees and messy roads were hampering their efforts.

They also delayed rescues of motorists stranded along highways in upstate New York, where 50 to 75 vehicles were towed overnight. A commuter train was also evacuated, and passengers were taken to a shelter, state troopers said.

Residents were urged to avoid travel altogether on Sunday. Speed limits were reduced on bridges between New Jersey and Pennsylvania, and a bridge in Delaware was closed. Roads closed because of accidents and downed trees and power lines, said Sean Brown, a spokesman for the Pennsylvania Department of Transportation.

Two of the airports serving New York City, Newark Liberty and Kennedy, had hours-long delays Saturday, as did Philadelphia's airport. Commuter trains in Connecticut and New York were delayed or suspended because of downed trees and signal problems. Amtrak suspended service on several Northeast routes, and one train from Chicago to Boston got stuck overnight in Palmer, Mass. The 48 passengers had food and heat, a spokeswoman said, and were taken by bus Sunday to their destinations.

Some train service had been restored by late Sunday, but delays were expected.

In southeastern Pennsylvania, an 84-year-old man was killed when a snow-laden tree fell on his home while he was napping in his recliner. In Connecticut, the governor said one person died in a Colchester traffic accident that he blamed on slippery conditions.

And a 20-year-old man in Springfield, Mass., who stopped when he saw police and firefighters examining downed wires, was electrocuted when he touched a wooden guardrail that had been electrified.

October snowfall is rare in New York, and Saturday marked just the fourth October day with measurable snowfall in Central Park since record-keeping began 135 years ago, the National Weather Service said.

But the unofficial arrival of winter was a boon for some. Two Vermont ski resorts, Killington and Mount Snow, started the ski season early by opening one trail each over the weekend, and Maine's Sunday River ski resort also opened for the weekend.

@TwiliXDragon: Actually, this takes place way before Zuko is even born, this is right before the great war comes around, with Sozin being the Fire Lord at the time. However, you may create Sozin's daughter, since his offspring were never really named or confirmed.

Can I create a Fire Nation rebel? It's implied that Sozin went away with many Fire Nation traditions and subjugated the Fire Sages. Not everyone could have liked that. Even Nazi Germany had the White Rose.

Russia launches first space flight since crash

MOSCOW (Reuters) - Russia launched its first unmanned space flight to supply the International Space Station Sunday since an August crash left a half-sized crew on the orbital outpost and raised concerns over Moscow's role as the sole space flight provider.

The Progress freighter blasted off from the Baikonur Cosmodrome in Kazakhstan as scheduled at 6:11 a.m. EDT, carrying supplies to the station, a $100 billion project funded by 16 nations currently orbiting about 240 miles above Earth.

"The vehicle is reported to be going by the book, it is on the money," NASA TV said on its website www.nasa.gov.

It showed the freighter take off under bright sunshine in the Kazakh steppe, carrying nearly 3 tons of food, fuel and supplies including oxygen and clothes and even iPads.

It is expected to dock Wednesday at the station, which is as large as a five-bedroom house and took the United States more than 10 years to build. It is used to conduct research and test new technologies in the unique environment of microgravity.

All Russian space flights were suspended after the Progress failure, leaving a half-size, three-member crew on the space station consisting of U.S. station commander Mike Fossum, Russian cosmonaut Sergei Volkov and Japan's Satoshi Furukawa.

A new crew is now expected to fly to the outpost on November 14, arriving two days later.

Since the retirement of the U.S. space shuttles this summer, Russian Soyuz capsules are the only ships capable of flying crews to the station, a service that currently costs NASA about $350 million a year.

NASA is seeking $850 million this year to help U.S.-based private companies develop space taxis, with the goal of breaking Russia's monopoly on station crew ferry flights before the end of 2016.

Tornado chasers swap storm stories at weather festival (Reuters)

NORMAN, Okla (Reuters) ? Here in the heart of Tornado Alley, they give awards for the worst hail damage on vehicles driven by the motley collection of civilians known as "storm chasers."

It's a good-natured nod of respect from the National Weather Center professionals to the mostly amateur ranks of people who crisscross the land following the most violent weather in the country.

Fifty-one chasers showed up in Norman, Oklahoma, over the weekend to reminisce, swap weather war stories and take a deep breath in their "off-season" -- the cool, crisp fall when a tornado is unlikely to rear its head anywhere in North America.

The event was the National Weather Festival, an open-house style event at the 5-story, $69 million National Weather Center building at the University of Oklahoma, where the National Oceanic and Atmospheric Association (NOAA) is the primary tenant.

The storm chasers and their vehicles were among the hottest attractions, partly because the year 2011 has been a horrid year filled with recurring media images of tornadoes and their aftermath.

With 549 killed by tornado-related weather, NOAA says it was the fourth deadliest tornado year in United States history (1925 was the worst, with 794 fatalities.)

The Joplin, Missouri, tornado on May 22 was the worst: 162 killed according to local authorities. It was the seventh-deadliest in U.S. history and the worst since modern record-keeping began in 1950, according to NOAA.

'NOT GOOD'

For the chasers who were there, the Joplin twister is not something that evokes an animated spate of story-telling. Instead, they get a bit quiet.

"Joplin was," said Brian DePriest, before pausing, "not good."

"You're never used to it," said the 39-year-old chaser from Springfield, Missouri.

As a group, the storm chasers fall into four subspecies: spotters, students/researchers, professionals and TV chasers.

Yes, it's exciting and at times thrilling, they all report.

There is a general consensus, though, that unless you have your own television show, like Reed Timmers of the "Storm Chasers" program on the Discovery Channel, there's not a great deal of money to be made.

"Most people don't break even," said Denton Sachs, 20, an electrical engineer from Texarkana, Texas, who caught a lot of attention at the Weather Festival with his storm-chasing vehicle: a sleek, black 2011 Dodge Challenger.

Most chasers drive SUVs or pickups, but with an HD camera in front and a remote-control camera on his trunk, Sachs said he can stream live storm video from his Challenger as effectively as someone in an hardier vehicle.

He tries to steer clear of hail damage by keeping a close eye on his radar display.

At the other end of the age and experience spectrum is Mike Weiss, 41, who has been chasing storms for 19 years -- "before it was cool," as he put it.

PUBLIC SERVICE

He doesn't take video or photos and does it simply as a public service with Central Oklahoma REACT Team 6023, he said.

As a storm spotter, he reports what he sees to the National Weather Service and other government agencies.

If there's a misconception about storm chasers, Weiss said, it's that storm chasers are all thrill-seeking daredevils. If you don't know what you're doing, he added, it's a good hobby in which "you can get yourself killed," he added, without a grin.

Janette Bontempo, a 41-year-old homemaker from Sherman, Texas, followed the supercell storm that turned into the tornado that flattened the tiny Oklahoma town of Tuska, killing two on April 14.

"We had to do search and recovery," she said. "Some people will pay to go storm chase and they don't realize there's a human factor to it."

Even so, there was a healthy showing of young people who are new members of the swelling storm-chasing ranks at the National Weather Festival. Many were out-of-state students pursuing meteorology degrees at OU.

Others, like Lawrence R. McEwen, are young people enjoying an expensive yet exciting hobby.

Standing next to his 2009 Ford Escape, McEwen conceded that the two big hail-stone circles in his windshield could be considered badges of honor for his weather passion.

He was more eager, though, to talk about the 30 cameras and seven laptop computers he employs in his chase vehicle, along with the 8,000 hours of storm video he has compiled since the age of 13.

But beyond all the gizmos and technology at his employ, McEwen, a 21-year-old who lives in Moore, Oklahoma, made clear he grasps the potential bottom line of storm-chasing: "So many people have died this year and that has really bothered me."

The Mighty Merrimac
?The accompanying engraving of the Merrimac is from a sketch furnished by a mechanic who came from Norfolk under a flag of truce. He says that he worked on her and is of course familiar with her appearance. The Merrimac was partially burned and then sunk at the time of the destruction of the Gosport Navy Yard last spring. We have had accounts from time to time that the secessionists had suc?ceeded in raising the Merrimac and were repairing her. The mechanic who fur?nishes the sketch says that her hull has been cut down to within three feet of her light-water mark, and a bomb-proof house built on her gun deck. Her bow and stern have been steel clad with a projecting angle of iron for the purpose of piercing a vessel.?

Rally fed by European debt deal begins to slow (AP)

PARIS ? The euphoric rally in share prices fed by a European deal to cut Greece's debt and prevent larger countries from falling down the same hole slowed on Friday, as investors began to recognize the significant challenges that still face the continent.

In the weeks before Thursday's agreement, markets had seesawed between hope that Europe would find a way to stop the crisis' march and despair that their response would be too cautious. After several delays and half-measures, the deal to greatly increase the firepower of the continent's bailout fund and to knock euro100 billion ($140 billion) off of what Greece owes hit the right notes, and stocks rocketed up on Thursday.

But analysts immediately raised questions about the lack of detail in the plan, and the euro and oil prices began pulling back on Friday.

"The best we can say is that the EU have engineered a temporary reprieve but there is no guarantee of a final resolution to the crisis," said Neil MacKinnon of VTB Capital.

Of particular concern is exactly how the bailout fund's new powers will work. The hope is that by using the euro440 billion ($615 billion) European Financial Stability Facility to insure against some losses on the bonds of wobbly countries like Italy and Spain, Europe will be able to avoid ever having to mount a rescue again.

A first test of how much this has reassured investors could come Friday, when Italy auctions off bonds. Worries about Italy have driven up its bond yields ? how much it has to pay to borrow ? and the fear is it could eventually be unable to afford to borrow from markets, as Greece was.

"It is all too obvious that the outlook for Italian bond yields is closely intertwined with the fate of EMU (European Monetary Union)," said Jane Foley, an analyst with Rabobank. "If Italian bond yields can be contained the chances that EMU can continue to stumble forward are good. If not, the outlook is dire."

Also, although the deal threw a lifeline to Greece, it asks banks to shoulder much of the cost by accepting losses of 50 percent on the Greek bonds they hold. Many of the continent's banks are already struggling with tighter access to the loans they need to run their day-to-day operations, and the prospect of substantial losses could further weaken them.

Markets appeared to be starting to absorb some of that skepticism by Friday and saw only small gains.

Britain's FTSE 100 was up 0.2 percent at 5,723.71. Germany's DAX gained 0.6 percent to 6,376.85 and France's CAC-40 rose 0.5 percent at 3,385.93.

The euro was already pulling back after a meteoric rise in the hours after the deal was agreed. It fell 0.2 percent to $1.4153 on Friday.

Wall Street was expected to open lower. Dow Jones industrial futures fell 0.2 percent to 12,140 and S&P 500 futures were 0.3 percent lower at 1,278.50.

Earlier in Asia, stocks were still riding the bump from the deal.

Japan's Nikkei 225 index jumped 1.4 percent to close at 9,050.47, its highest close since Sept. 1. Hong Kong's Hang Seng gained 1.7 percent to 20,01924 and South Korea's Kospi rose 0.4 percent to 1,929.48.

Australia's S&P/ASX 200 gained 0.1 percent to 4,353.30 and the Shanghai Composite Index added 1.6 percent to 2,473.41. Benchmarks in Singapore, Taiwan, Indonesia and Thailand were also higher.

Benchmark crude for December delivery was down $1.32 at $92.60 a barrel in electronic trading on the New York Mercantile Exchange.

Brent crude was down $1.14 at $110.94 a barrel on the ICE Futures Exchange in London.

Europe crafts debt deal that pleases markets (AP)

BRUSSELS ? European leaders clinched a deal Thursday they hope will mark a turning point in their two-year debt crisis, agreeing after a night of tense negotiations to have banks take bigger losses on Greece's debts and to boost the region's weapons against the market turmoil.

After months of dawdling and half-baked solutions, the leaders had been under immense pressure to finalize their plan to prevent the crisis from pushing Europe and much of the developed world back into recession and to protect their currency union from unraveling.

World stock markets surged higher Thursday on the news. Oil prices rose above $92 per barrel while the euro gained strongly ? a signal investors were relieved at the outcome of the contentious negotiations.

"We have reached an agreement, which I believe lets us give a credible and ambitious and overall response to the Greek crisis," French President Nicolas Sarkozy told reporters after the meeting ended early Thursday. "Because of the complexity of the issues at stake, it took us a full night. But the results will be a source of huge relief worldwide."

The strategy unveiled after 10 hours of negotiations focused on three key points. These included a significant reduction in Greece's debts, a shoring up of the continent's banks, partially so they could sustain deeper losses on Greek bonds, and a reinforcement of a European bailout fund so it can serve as a euro1 trillion ($1.39 trillion) firewall to prevent larger economies like Italy and Spain from being dragged into the crisis.

After several missed opportunities, hashing out a plan was a success for the 17-nation eurozone, but the strategy's effectiveness will depend on the details, which will have to be finalized in the coming days and weeks.

The most difficult piece of the puzzle proved to be Greece, whose debts the leaders vowed to bring down to 120 percent of its GDP by 2020. Under current conditions, they would have ballooned to 180 percent.

To achieve that massive reduction, private creditors like banks will be asked to accept 50 percent losses on the bonds they hold. The Institute of International Finance, which has been negotiating on behalf of the banks, said it was committed to working out an agreement based on that "haircut," but the challenge now will be to ensure that all private bondholders fall in line.

It said the 50 percent cut equals a contribution of euro100 billion ($139 billion) to a second rescue for Greece, although the eurozone promised to spend some euro30 billion ($42 billion) on guaranteeing the remaining value of the new bonds.

The full program is expected to be finalized by early December and investors are supposed to swap their bonds in January, at which point Greece is likely to become the first euro country ever to be rated at default on its debt.

"We can claim that a new day has come for Greece, and not only for Greece but also for Europe," said Greek Prime Minister George Papandreou, whose country's troubles touched off the crisis two years ago. "Let's hope the worst is over."

Since May 2010, Greece has been surviving on rescue loans worth euro110 billion ($150 billion) from the 17 countries that use the euro and the International Monetary Fund since it can't afford to borrow money directly from markets.

In July, those creditors agreed to extend another euro109 billion ? but that plan was widely panned as insufficient.

Now, in addition to euro30 billion in bond guarantees, the eurozone leaders and IMF said they will give Greece euro100 billion ($139 billion) in new loans.

With the banks being asked to shoulder more of the burden, though, there were concerns they needed more money in their rainy-day funds to cushion their losses. So European leaders have asked them to raise euro106 billion ($148 billion) by June.

The last piece in the complicated plan was to increase the firepower of the continent's bailout fund to ensure that other countries with troubled economies ? like Italy and Spain ? don't get dragged into the crisis. The third- and fourth-largest economies of the eurozone are too large to be bailed out like the smaller euro nations Greece, Portugal and Ireland have already been.

To that end, the euro440 billion ($610 billion) European Financial Stability Facility will be used to insure part of the potential losses on the debt of wobbly eurozone countries like Italy and Spain, rendering its firepower equivalent to around euro1 trillion ($1.39 trillion).

That should make those countries' bonds more attractive investments and thus lower borrowing costs for their governments.

"These are exceptional measures for exceptional times. Europe must never find itself in this situation again," European Commission President Jose Manuel Barroso said after the meetings.

In addition to acting as a direct insurer of bond issues, the EFSF insurance scheme is also supposed to entice big institutional investors to contribute to a special fund that could be used to buy government bonds but also to help states recapitalize weak banks.

Such outside help may be necessary for Italy and Spain, whose banks were facing some of the biggest capital shortfalls.

Using the insurance promise, the eurozone also hopes to attract big institutional investors from outside the eurozone, such as sovereign wealth funds, to contribute to a separate fund that would back up the EFSF.

Sarkozy was due to speak to Chinese President Hu Jintao later Thursday. On Friday, the head of the EFSF, Klaus Regling, will travel to China, which has huge cash reserves, to detail the insurance plan.

So far, Beijing has promised to help only by continuing business as usual, trading with Europe and stockpiling some of China's multibillion-dollar trade surpluses in the safest European government bonds.

On the markets, European trading was buoyant from the outset Thursday on the news. Britain's FTSE climbed 2.1 percent to 5,670.12. Germany's DAX jumped 3.5 percent to 6,227.61 and France's CAC-40 gained 3.6 percent to 3,282.32. Shares in Asia posted solid gains earlier in the day.

Ben Stiller Reveals Zoolander 2 Details

The great Derek Zoolander once said, "There's more to life than being really, really ridiculously good looking." Well, he may learn the true meaning of that in 'Zoolander 2.' In an interview with The Hollywood Reporter, Ben Stiller revealed some tidbits about the upcoming sequel, which will pick up ten years after the last movie left off. As Stiller tells it, the plot will focus on "Derek's 'School For Kids Who Can't Read Good,' [which] has been destroyed, leaving him in charge of its pupil." The story sounds promising, however, the movie almost happened sans Stiller. (Seriously.)

The actor admits that "at one time I walked away from it and they had somebody else rewrite it and they were going to do it without me, which was kind of ironic. Then it came back around." We can't imagine another 'Zoolander' without, well, Zoolander, so we're not sure how that would've worked out.

GOP seeking waiver of environmental laws at border (AP)

WASHINGTON ? Federal agents trying to patrol the U.S.-Mexico border say they're hampered by laws that keep them from driving vehicles on huge swaths of land because it falls under U.S. environmental protection, leaving it to wildlife ? and illegal immigrants and smugglers who can walk through the territory undisturbed.

A growing number of lawmakers are saying such restrictions have turned wilderness areas into highways for criminals. In recent weeks, three congressional panels, including two in the GOP-controlled House and one in the Democratic-controlled Senate, have moved to give the Border Patrol unfettered access to all federally managed lands within 100 miles of the border with Mexico.

Two of the panels expanded the legislation's reach to include the border with Canada.

The votes signal a brewing battle in Congress that will determine whether border agents can disregard environmental protections as they do their job.

Dozens of environmental laws were waived for the building of the border fence, and activists say this is just another conservative attempt to find an excuse to do away with environmental protections.

But agents who have worked along the border say the laws crimp their power to secure the border.

Zach Taylor, a retired Border Patrol agent who lives about nine miles from the Arizona-Mexico border, said smugglers soon learn the areas that agents are least likely to frequent.

"The (smuggling) route stays on public lands from the border to Maricopa County," Taylor said, referring to the state's most populous county. "The smugglers have free rein. It has become a lawless area."

Environmental groups said lawmakers lining up to support the legislation have routinely opposed the Endangered Species Act, the Safe Drinking Water Act and dozens of other laws, and they accused the lawmakers of using illegal immigration as the latest excuse to gut protections.

"For every problem that's out there in society, there's some extremists in Congress who say the solution is, `Well, let's roll back the environmental laws, let's open up the public lands,'" said Paul Spitler, spokesman for the Wilderness Society. "It doesn't comport to reality, but it fits their mindset that it's simply the environmental regulations that are holding back America."

Nearly 40 percent of the land on the U.S.-Mexico border and about a quarter of the land on the U.S.-Canadian border is public land, including Big Bend National Park in Texas and Glacier National Park in Montana. Driving is prohibited on those parts of the land that are designated wilderness areas.

Wildlife officials say vehicle use can be particularly hazardous in the desert. Water gathers in the tire tracks instead of in natural pools and evaporates more quickly, leading to less vegetation and less available food. Some areas, such as Big Bend and the desert farther west, are deadly to traverse in certain months and immigrants and smugglers avoid them.

The wilderness areas also have other restrictions on development. Border patrol agents, for example, must get permission from other federal agencies before maintaining roads and installing surveillance equipment. Federal auditors found it can take months to get that permission.

"What the Border Patrol says they really need down there is not necessarily more manpower or money," said Rep. Rob Bishop, R-Utah, whose bill easing the restrictions passed the House Natural Resources Committee along party lines. "They need more east-west access on those public lands."

Sen. John McCain, R-Ariz., sponsored an amendment that requires the Agriculture and Interior departments to give Border Patrol personnel immediate access to federal lands on the southern border for security activities, including for routine motorized patrols. The amendment passed a Senate committee with the support of five Democrats and eight Republicans.

McCain told colleagues that up to 100 people sit on mountaintops near the border serving as lookouts for smugglers, suggesting that improved law enforcement access on those mountains would deter the lookouts.

"What he says is absolutely true," said Democratic Sen. Mary Landrieu of Louisiana, who visited Arizona with McCain. "For the life of me, I can't understand the hesitancy on the part of Interior or Agriculture to provide access to border security guards."

Rep. Ben Quayle, R-Ariz., sponsored a similar amendment that extends the law to the Canadian border as well, and it passed by a voice vote, which is usually reserved for noncontroversial legislation.

During a House subcommittee hearing in April, Ron Vitiello, deputy chief of the U.S. Customs and Border Patrol, said he had "no complaints" about environmental laws.

But George McCubbin, president of the union that represents about 17,000 Border Patrol agents and support staff, likened current policy to telling city police officers they can't patrol a particular neighborhood.

"If they want to get serious about this problem on the border, they can't be restricting areas we go in," said McCubbin, who works in Casa Grande, Ariz. "Don't let us there and you have nothing but the bad element going through that area."

The Government Accountability Office, Congress' investigative arm, reported that supervisors at 17 of 26 Border Patrol stations along the Mexican border said access to federal lands had been limited because of environmental restrictions. Yet, the vast majority of the agents in charge also said that they were generally able to adjust their patrols without sacrificing effectiveness.

Democratic lawmakers and environmental groups cite the GAO's findings in arguing against giving the Border Patrol authority to operate as it sees fit on federal lands.

"The record is clear. The problem this bill claims to be solving does not exist," said Rep. Raul Grijalva, D-Ariz. "So, if this is not about border security, what is it about? It's about undermining fundamental environmental protections for millions of Americans."

Bishop said federal agents would be better stewards of sensitive lands than illegal immigrants and smugglers.

"What is so ironic is that the environmental degradation is not being done by the Border Patrol," Bishop said. "It's being done by the illegals who are coming across."

Stallone sued over alleged screenplay theft

Action movie star Sylvester Stallone is accused in a lawsuit of copying another writer's screenplay to make "The Expendables," a movie about mercenaries hired to defeat a military dictator.

The lawsuit was filed in Manhattan federal court on Tuesday by writer Marcus Webb, who said the screenplay for "The Expendables" is "strikingly similar and in some places identical" to his work entitled "The Cordoba Caper."

Webb seeks unspecified damages for copyright infringement and an order from the court stopping further infringement in any sequel by Stallone, his credited co-author David Callaham, Millennium Films, Nu Image Films and Lions Gate Entertainment Corporation.

Representatives of Stallone and other defendants could not immediately be reached for comment.

"The Expendables" ? produced by Millennium and Nu Image and distributed by Lions Gate ? was released worldwide on Aug. 13, 2010. It featured a cameo appearance by Arnold Schwarzenegger after he left his post as California governor, along with other aging action heroes Stallone and Jet Li.

According to the lawsuit, Webb registered "The Cordoba Caper" screenplay and a short story with the same title and plot with the U.S. Copyright Office in June 2006. Between 2006 and 2009, the lawsuit said, the screenplay was made widely available by Webb for consideration in the movie industry.

"There can be no dispute that Stallone and/or Callaham had access to and copied protectable elements of the screenplay," the lawsuit said.

"The Cordoba Caper" tells the story of a team of elite, highly-trained mercenaries hired to defeat General Garza, a rogue army general of a small Latin American country," the lawsuit said.

The court document provides details of the ways in which Webb sees similarities between his screenplay and the released movie, including the opening "with a hostage rescue at sea, off a foreign coast, which has nothing to do with the main plot."

It said the main villain in both is a General Garza, a military dictator with a notorious human rights record.

Webb said he has been deprived of benefits from the screenplay such as potential earnings from the production, distribution and performance of "The Expendables."

"Expendables 2," a sequel to "The Expendables," is due for release on Aug. 17, 2012.

The case is Marcus Webb v. Sylvester Stallone, et al, U.S. District Court for the Southern District of New York, No. 11-7517.

COMMENTARY | The day after he refused to take a stance on Ohio's Issue 2, GOP presidential candidate Mitt Romney jumped on the Gov. John Kasich bandwagon to endorse the controversial union-busting bill.

The problem for Romney is this week's Quinnipiac poll shows the issue losing by 25 points. Ohio Issue 2 is a voter referendum to overturn Senate Bill 5, which virtually eliminates public unions' collective bargaining rights. In the final poll before the election, 57 percent of those polled believe the law should be overturned.

Romney isn't the only Republican hopeful to climb on the bandwagon, according to the Associated Press. "True conservative" Rick Perry said "Gov. Kasich and the Republican leadership of Ohio are to be commended for their efforts." Also-ran Jon Huntsman preferred to use a true conservative medium to Tweet his message: "Unlike @MittRomney, I stand with John Kasich in opposing the individual mandate and supporting public sector union reform."

Even with its past position as a strong swing state, Ohio is solidly on the right. The 2010 midterm elections washed a red wave over state government, giving control of the House and Senate to the Republicans. But with the citizens so polarized over the attack on unions, this GOP allegiance could spell Buckeye doom for any presidential candidate endorsing the end of collective bargaining.

As the GOP race changes front-runners more often than Lindsay Lohan goes to jail, Romney would have been smart to ignore the baiting from Perry and Huntsman. While in Ohio, he preferred to look at his supporters and defer to states' rights. Yet, once he was near Washington, he felt removed enough from those Ohioans to voice his support for the measure.

Maybe Romney thought no one in Ohio would hear him from Washington.

There are many Ohioans that do support Issue 2 and it's certain Romney, Perry and Huntsman were pandering to those voters. Unfortunately for them, the GOP candidates who keep quiet about such a decisive states' rights issue might race back to the top of the leaderboard.

Kelly Clarkson Admits: I've Never Been in Love!


Kelly Clarkson has taken a break from singing about love to talk about love, admitting in a new interview: I've never been in it!

"I've never been in love," the artist tells USA Today. "I've never experienced certain things, and I think that's because I have this side of me that is shut off. Because I haven't found anybody yet to open to that I feel like, 'OK, you're worth breaking down that wall for.' I've never found that."

In promotion of her fifth studio album - "Stronger," out today! - Clarkson has been opening up more than usual about her personal life. She recently went on record with her heterosexuality. Still, don't expect any tabloid headlines to spring up any time soon.

"I have no controversy," Kelly says. "You don't see me in rehab, or you don't see me coming out with my hey-haw showing. There's not much to report."

But would Clarkson mind if a magazine could at least report she's truly fallen for someone? It doesn't sound that way, it's just a challenge, given her schedule.

"It's really hard to date when I'm on four different continents in a week," she says. "Even if I do meet a great guy, I ain't ever gonna see him. There's only so much you can do with Skype!"
